Consumers have endless rights these days, but unfortunately, most of them are theoretical and almost impossible to enforce.
The one undeniable right the buyer may have is the right to initiate a chargeback if he funded the payment or even just the deposit with a credit card. If that's the case, he won't struggle to get his card issuer to dispute the payment under section 75 of the consumer credit act. If the OP does find that any part of the car was paid for with a credit card I'd be happy to complete the relevant paperwork for the buyer. Traders who deny consumers their rights do it with impunity because they know that most times the buyer won't be up for a fight. Like the trader who sold me a broken load cover, promised to sort it out then simply stopped posting on here or replying to emails. It's a sad fact of life that a social media campaign is far more likely to shame a dodgy car dealer into honouring his obligations than just about anything else. Of course, for that to be effective, said trader has to give a fig what people think of him. I feel for the old fella, I hope there is something constructive we can do for him. |

Hmmm Dunstable is nnear luton, luton is where a certain mgrover "specialist" is... if he got the car from there Then no chance of any comeback.
Assuming its a 1.8 then the job is not too bad, its just a pain to have to do it so soon afafter buying, especially at this time of year...

mind you I have been told off by said facebook group for posting links to help articles on here where people have asked how to do stuff .... apparently there is some bad blood between the owners of the group and here...or so I was told by a moderator ...

The law states that goods should be fit for purpose. Warranties are optional by the dealer/manufacturer, are an added benefit and are not designed to affect a consumer's statutory rights.
Technically speaking a consumer has 6 years (yes 6 years recall) and this is not just cars. Obviously the vehicles age, mileage, use, and fair wear and tear need to be taken into account. But it doesnt matter if the car is £100 or £10,000, the law still applies. This person concerned definitely has a case and should return the car for repair. If not he could take the garage to the small claims court, which can be carried out easily on-line for a small initial fee. It will fall in his favour. |
