In theory Construction and Use regs do require auto levelling and headlamp washers for HID lights - and MOT tester notes make reference to this.

In practice not many MOT testers and zero Police seem to know the rules so these rules aren't really enforced.

auto levelling and headlamp washers not required for MOT in England, Scotland and Wales if you have xenons fitted. MOT Test handbook simply states that they should be working IF fitted. There's nothing that says they have to be fitted. Headlamp washers are only testable on cars first registered from September 2009 on wards, so our cars are too old to ever fail on headlamp washers not working.

On some late 80's/early 90's cars which were the first to have xenons fitted they didn't have any headlamp washers or self levelling fitted from factory. Some of the early xenon headlights also had reflector housings rather than projector.
