Advice over a Dog (its a long one this)
Any advice here would be very helpful especially if someone knows the legal side of this.
Just over a year ago when my daughter was living with her boyfriend they bought two dogs a staffie and an american bulldog. They then came to visit for what was supposed to be a week but ended up living with us again for 3 months. They where having difficulties where they where living and looked for somewhere else to stay. They found a Flat in Sunderland and decided they where going to move there. I explained to them that its not fair on the dogs to be put in a flat especially with two young children. They agreed and gave back the staffie to the lad they bought it off as it was 8 years old. The bulldog was only a pup and we actually fell for it not the type of dog i would usually think of as a family pet but she grew on us. So we agreed to take her off their hands when they moved out as we could give it a better life. We already had a Dog at home and they got on so seemed the best thing to do. Since then they have split (but thats another story). now he is being a bit of a tool with my daughter and tonight has demended that he gets the Dog back as its his dog. I actually dont know if I have any legal rights to keep the dog (saying that if he turns up here at my door to get her the only thing he will be walking away with is a black eye). As far as I know he has no where to live and is dossing on a mates couch, I have had no contact with the scroate since they split. In my opinion all he wants her back for is to sell which would be a great shame as she is a loving funny dog and if he sells her its only going to be to the Chav type who I dont imagine will treat her as wee do. As you can imagine this is very upsetting for my wife who loves her to bits. So anybody know where I stand on this issue?

Sorry to hear about this.
My dog Oscar, I love him to bits. I wouldn't let anyone take him off me. I would simply refuse to hand her over, dogs have feelings just like us and if she is happy then she needs to stay with you. You could say the dog has cost you £X in your ownership. Food, bedding, worming treatment, treats, toys, bedding, kennelling costs.. (thats you) training costs..(thats you again).. That would amount to a lot indeed. If he believes she belongs to him then he must believe she never belonged to you then he can't believe you were going to attend to her every need for free, can he??!

At the moment I am not thinking straight as you can imagine I'm a bit angry and all I want to do his ... well you can imagine. There is now way I am handing her over to him he will have to take me to court

Hi Andy, sorry to hear of your problem, having 2 dogs myself and them being part of the family etc ,,,,,, i certainly know how you both feel.
Do you have a legal helpline as part of your household insurance ? Most bank accounts have a legal helpline you can phone nowadays too. Might be worth looking at both too see. Hope that outcome is a good one both for yourselves and the dog. Regards , Mark |
