Hey it's high time `court martials' were replaced by impartial civil courts, our `boys under fire' deserve our support not this krapola. I signed the petition and hopefully we can make a difference to reverse this miscarraige of justice. Mike.
*Please note, I have several blogs on google re such things, under "SeanScribes". England my once proud nation, I mourn your demise. Mike.

Thanks for pointing that out. It is clearly more complexed than going through the civil courts. Petition signed.

There are some significant differences between the two jurisdictions:

Circumstances surrounding admissible and inadmissible evidence, grounds for appeal following the Judge Advocate (usually a serving officer of very senior rank having legal qualifications - not necessarily the same as a civilian judge) declaring verdict and passing sentence, and the absence of sufficient jury members (all serving officers although there may be independent observers) to consider on a similar basis to civilian counterpart.

There are unofficial points of view (and never admitted to) regarding the treatment of a defendant:
A defendant who is NCO or ’below’
A defendant who is a commissioned officer.

There is also the practice of trial in camera and the view taken by the defendant’s officers of his/her ’attitude’ which may be seen as non-esprit de corps. An individual officer will be intensely loyal to his junior comrades but may be subject to raised eyebrows if he fails to march to his senior’s tune. Wisdom occasionally prevails, but in many historical cases it has been observed that the regiment’s reputation is paramount.

It is also the case that the defendant is allocated counsel provided by the MOD.
