That highlighted line alone, suggests she should be paid based on previous earnings, rather than basic salary and at least until the date of the redundancy. After that I don't really know whether all payments should end completely, or continue. I suspect it ought to continue as if still employed - they cannot simply make someone redundant/ fire them etc. when they are off work due to illness or pregnancy, without due process.

You didn't make clear whether the £500 was being claimed back for the period prior to redundancy, or just after redundancy.

Lastly, as BRMFUN says - if she does have to repay the amount, their error - make them wait for it - offer them £5 a week.

Agreed it's too late to Join a union now. You need to see the T&Cs re maternity pay to be 100% sure. I know

Thank you all for your help and views. Have now emailed HR department asking for full explanation and confirmation under which rules or T&C they have reached their decision regarding overpayment and invoice for £566.43
