Jaguar XJ 3.0 V6 Auto (X350) & Hyundai Tuscon 2020

Default So this makes you think!

My Jaguar is due for paintwork on Friday. I live in Bridgend the paint shop is in Port Talbot just 3 Miles from my home. Under the Wales lockdown rules I cannot cross that border county to county.

And..... In October the Jag is booked in for some work and an MOT at Swallows Jaguar in Somerset. The car is always serviced here. Under the guidelines you must keep your car MOT'D and roadworthy, plus the MOT has already been extended 6 months due to COVID.

However, no travel outside the county unless deemed necessary. Is this necessary in the eyes of the law?

MOT extended by 6 months? So DVLA is ignoring safety and roadworthiness of the vehicle?

Yes all of UK had mot extension which was then removed from the end of August. However the car had to be roadworthy despite the extends.

I think you have to ask the question 'is it reasonable?' I would suggest that if there was a Jaguar specialist closer to you, then no - any court would look at it as black and white, without consideration to your preference. That is aside from a different county, you are going to a different country. Can the work be postponed to a later date? I imagine that your cars are all roadworthy and safe anyway.

But think back to the initial lockdown, where Wales effectively closed its borders, and Welsh people complained about Englishers coming into the country for a break. If it were me, I would postpone it.

How are they doing this? An MOT is only an indication of a vehicle's condition at that time. Not of its roadworthiness at any other time. The law states that all vehicles used on the road must be in roadworthy condition. That is the important part of using the car on the road. Not the MOT - a car is still insured even without MOT. If it is not in roadworthy condition, it will not be insured (any insurance I have had, states its roadworthiness as a proviso).

My own car has had its MOT extended from October 17th to April 17th 2021. Although in saying that, currently it would fail right now (for the common rust on the sill - about 2 inch by 4 after I poked it out, it will still jack up there securely). Would you suggest it is not roadworthy or safe? (It is booked in at a car restorers for repair though, with a pair of Tom Hobbs repair sections to save the guy some time).

lol, you do not want him to leave the police station even more confused lol (or a phone call). I would bet if you did contact a number of different police stations, you would receive different answers.

In fairness at the time everybody in Wales were under a 5 mile radius from home whereas in England you could have travelled from Lands End to the Scottish border. Anyone coming into Wales from England should have adhered to the 5 mile law from the border but they weren't despite the motorway matrix signs flashing the rules.

Also in England at the time most rules were guidance or instructions whereas in Wales restrictions have been written into law.

All that aside! News conference today has confirmed travel is permitted to support businesses, health reasons, work etc etc. However as I live in Bridgend for now there is no travel out of the county or non Bridgend citizens can come in.

Actually non residents have been instructed to leave.

I doubt it, mandatory MOT testing was reintroduced on the 1st Aug so 17th Oct is still your due date.

Yes all cars after 31st August must be tested by their due date. If unsure check the DVLA site for your date and see my link in the above thread.
