Unhappy Unemployed again

Hi All,

I have just joined the ranks of the unemployed thanks to my employers making me redundant, this is now my 5th redundancy during my working career and its fast becoming tedious looking for a new job again.

This time however, unlike previous cases, is a clear case of unfair dismissal and I have instigated legal proceedings against my ex employer.

What hacks me off is how its stacked up against the employee and in favour of the employer. Firstly I have to tell them what my grounds are for claiming unfair dismissal, this then gives them the opportunity to correct any procedural errors and arrive at the same so called conclusion ie I am redudant. Only now it is classed as a fair dismissal.

Furthermore if they offer me any alternative role withing the company at a very much reduced salary and I reject it then I am penalised when it comes to any compensation that the tribunal may award, even worse they base any award on the low salary job that was available to me.

How it all just stinks, when is UK plc going to play fair and start to penalise companies who do this sort of thing to employees.

Bad Luck Andy and hope you find new Employment quickly.
I have personally found in UK the Procedures for Unfair Dismissal very good, and generally more to the Employees advantage.
Obviously seek the right people with helping you to get what is rightfully yours.
Some Companies just find it easier to Cease trading, thus getting rid of all Staff then just restarting up again with those they want, in that case you are lucky to get anything out of Company, just the bare minimum From the Government.
What a time of year to be going all through this.

Angry unemployed again

Hi John,

Many thanks for the kind words. This company is still trading and in fact expanding and taking on new staff, one even at managerial level. A job I am well qualified to do but this was very carefuly closed off to me. They claimed the job and project for the job have been terminated. However thanks to a good friend and collegue, who sent me a copy of an email sent by MD the next day, informing all staff of my demise but that all jobs are safe and in fact they will be going ahead with the new project and continue to recruit a new lab manager.

I just wished that companies doing this are very severly punished in some way, all they get is a slap on the wrist and made to pay a small bit of compensation which in many cases is only a fraction of the monthly turnover.

I reckon it should be published in the National press and they also get a heavy fine on top.

Suggest when it gets to the Court you make sure the Nationals and your Local Paper all know your side of story with all proofs given.

Not good news at this time of year. However, get of the DfTi web site (or whatever they call themselves now) as there is some really good advice on building a case for unfair dismissal.

Having been through the couts as an employer, the legislation is very much weighted in the employees favour now.

Hopefully you'll get a good result.

Sorry to hear about your dismissal. It might be worth having a look at our daughter's website www.kea-hr.co.uk. It is a bit geared towards employers because they usually have the money, but there is a fair amount of free stuff on there as well.
