Once upon a time there were 3 MOT certificates Red Fail ordinary fail and pass.If a red certificate was issued the only way that vehicle could be moved was via a trailer whilst the new system does not seem to go as far dangerous fail is not really new the test in those days had less testable items.

In the past it was always legal to take a car with no Mot to the garage for a pre-booked mot, and if it failed, take it away to be repaired.
Is it now no longer legal to take away a car that has failed?

Obviously, if the failure is for something actually dangerous, or that makes the car unsafe, then one could be prosecuted for driving a car in a dangerous condition, but not for not having an mot.

The car has to be insured, of course.

As I understand it, once a vehicle fails with a dangerous category item then its current MOT is null and void, even if it had time left on it.

If you then drive it you could be liable to prosecution and your insurance would not cover you should an accident happen.

We on this forum, are mainly enthusiasts who take above average care of our old cars, checking and maintaining them regularly. Most motorists drive newer cars which often get little attention between yearly services and MoTs, especially young drivers who appear to have little understanding of the need to check fluids and tyres at least weekly. So after a year of neglect, there will be many fails, now categorised 'Dangerous', which will clog up garages if the owners are unable to remove them, even if only waiting a day or 2 for replacement parts. And a lot of people will have to find alternative ways of getting to work. It strikes me too, that 'MoT only' outfits should not be allowed - if you can't fix a car, you shouldn't be able to fail it.

On the younger drivers seem to have little understanding of the need for checks I agree.
I've asked a few about their tyre pressures and not only do they not know what they are they have no idea where to find the information. .Apparently it's something that the garage check when it's serviced Aarrgghhhh........

On the MoT only outfits should not be allowed I wholeheartedly disagree.

For these businesses there is no potential profit to be made by deliberately failing a car. And, as we have seen in this thread, that happens. The lure of easy money is just too much for some.

We have a group of three centers in the Midlands (Alan's Test Centres) which I have used many, many times for both bikes and cars.

They are extremely knowledgeable and will happily show you the item that causes a fail and explain why.

And what about the Local Authority ones?

I believe MoT testers have their own training, testing and regulation so are "qualified" as competent to carry out the test.

It seems the 'dangerous' category is the one likely to cause the most difficulty for people.
Combine that with fears that a few places may be less than scrupulous in thier approach to the matter.it would be really usefull if anyone had a definitive list or link to the items to be classified as dangerous under the new regime if they could post it here.
As i understand it the items are pre defined and the idea is to try and make results more consistent (although I suspect a push from the manufacturers to 'clear space on the roads' for new vehicles could be behind it.

Any MOT garage which also does repairs, has a built in incentive to fail cars which ought to have passed, simply for the extra work.



An MOT only place, has no such financial incentive to pass or fail it.
