Question Sale of Goods Act

Any experts here on the Sale of Goods Act?

I have an 18-month old TV which has developed a fault. The online retailer's guarantee is 12 months (as is the manufacturer's) - am I covered under the Sale of Goods Act?

Depends.
If it is one of the Cheap models highly unlikely,
but if a Proper set at a proper price so to speak then yes,
comes under reasonable expected time expected to work.

Hmmm it's a toughie.I would say no but that depends how persistant you are and how much noise you make. You would have to prove it wasn't fit for purpose but how you do that I don't know. Is it acceptable that an 18 month old telly develops a fault? It's certainly worth a go, phone the consumer advice helpline (google should get you it) and get some advice as how to proceed.

Do you have proof of purchase? Take it back, ask them to replace or repair it, if they tell you to go to the manufacturer start quoting sale of goods 1979 at them. It's their responisbility, its' a SONY, should last longer than 18 months without a doubt.

That should be covered by Sale of Goods act as not of use after limited time.
Not down to Sony but the Retailer to sort.
Also report to Trading Standards if any problem.

If used in Commercial Premises, Kitchen or up to the expected life of LCD screen then you have problems but in the Domestic environment not normally possible to have met that yet.
Only other thing if mounted above any Heat source it is a Cop out for Warranty as clearly says not to be installed there.

At the end of the day is the item of suitable quality?

This is a tricky one to proove either way and tends to be something that is decided in the small claims court.

The truth is the more expensive the item the better it should be and of higher quality. Branded goods like Panasonic should last longer than cheapo brands like Bush.

the liability of store depreciates with time. The 12 month Gtee is just something the shop gives you in addition to the entitlement of the sales of goods act.

What normally happens in shops like currys and comet is they will state 'no, go away, it's out of warranty etc..' for a while but if you make a fuss they will accept some form of liablity towards the repair cost.

A comon figure is 75% in the second year depreciating by 25% per year afterwards.

Manufacturers often will also accept the cost of repairs as the brand also has a reputation to uphold.

I had my Denon hifi fixed for free 3 years after it was purchased. I contacted the manufacturer and they said just return it to any Denon authorised reseller and they would send it back to Hayden labs (Denon) on my behalf for a £10 charge. All labour and parts was free and the item has worked faultlessly since.

Anna - yes I have the receipt (20/8/07) but the online retailer is in Bradford which is a bit of a trek from here, especialy if it involves 2 x round trips. Any TV should last longer than 18 months (Sony or otherwise) unless it's been kicked around - which this one hasn't.

John - it's been in a lounge since day 1 and mounted on a Sony cabinet stand - no heat source withing 8 feet.

I'm having a Sony engineer look at it tomorrow -after which I'll try the 'not fit for purpose' line with the retailer.

I know Sony had problems with the D series Bravias caused by the digital EPG system (Electronic Programme Guide) downloading too much info and not emptying the buffer. This causes the set to switch off then back on again on its own. (which this one did before it went loopy as in above pic).
