Default Manslaughter now Murder / Pistorius to return to court

Oscar Pistorius is to return to Court after his manslaughter conviction is changed to murder on appeal, he will then be sentenced on new verdict.

Yes - it puts right the rather odd original decision that an individual could let off four shots into a very confined space and then claim it was manslaughter not murder.

It matters not that he did not know his girlfriend was in the loo - the fact is that whoever was in there had literally 'no where to go" - they were trapped.

So four shots with dum-dum type bullets was a deliberate act and he must have known that whoever was on the other side of the door would be killed.

It is like someone setting out to kill someone but is a bad shot and kills someone else instead. This killing of the third party is still murder - it cannot possibly be manslaughter on the basis that the person the killer intended to kill was not killed and the person killed was killed by mistake.
