Wills and Inheritance
I have been watching tonight's episode of Inheritance Wars on Channel 5, 9pm start.
From what I understand, a Will is automatically superseded if a marriage takes place, after the Will is made. The new husband or wife becomes the beneficiary. I did not know that. macafee2 |
I do believe that getting married invalidates an existing will. I was therefore somewhat surprised at the previous episode, when the courts ruled that an existing (pre-marriage) will was still valid, because the guy died before signing his new will.

I confess, I was unaware that an unnamed beneficiary could inherit a will. If that is the case then Common Law must therefore take precedence and a judicial process might apply. It might be risky to assume the earlier marital preference is maintained in the latter. Unless of course a final d/bed declaration is made. Hmmm...
